No employer can afford not have workplace drug and alcohol testing policies and procedures.
Federal and State Workplace Health and Safety Legislation place an obligation and an onus on both the employer and the employee. If the employer is aware, or should reasonably be aware, that an employee and/or contractor has an alcohol or drug related problem, it has a positive duty to take reasonable steps to protect that worker and others from injury which might reasonably occur due to the acts or omissions of the affected worker. The company also has the obligation to take reasonable steps to protect the worker and all other individuals who may be injured as a result of foreseeable risks associated with misuse or abuse of alcohol and or other drug(s). The employer also has an obligation to ensure that the employee is fit to work.
The employee has an obligation not to place at risk the health of another person at the workplace.
